My upload of this file was under the assumption that, since it was created by an arm of the Canadian Government (an edition of the entire document was published in 1960) and such documents are free of copyright under Canadian law after 50 years, then it is free for use. I was unaware that US law could interfere with this and I would appreciate a definitive ruling. Some maps and pictures in the document were clearly created during WWII or based upon material created during WWII - what is their status? Folks at 137 (talk) 21:41, 23 October 2013 (UTC)[reply]

In Canada, the copyright to works by the Canadian government expires 50 years after they were published. Some works are published shortly after they are made, other works are not.
In the United States, works by the Canadian government are usually in the public domain if the copyright expired in Canada before 1996. If the copyright didn't expire in Canada before 1996, then the copyright normally expires in the United States 95 years after the work was published. Given that the main work, that includes this and other maps and pictures, was a Canadian Govt print publication by 1960 then its copyright expired in 2010, ie, copyright was in force in Canada in1996. It seems that this map and others from the same source should be deleted - don't know how, could someone do the dirty deed? Was there a reason that the US decided to extend copyright way beyond the originator's native rights? Seems very restrictive on Wiki; I'm miffed. This and the spying on French and German (and other?) friendly governments may encourage host servers to be established outside US jurisdiction. USA doesn't use the rule of the shorter term. However, in the past, USA required a copyright notice on all publications, and then a copyright renewal 28 years after publication. Most publishers outside the United States didn't know about this, and the publisher may have thought that a renewal was a waste of time and money as the publisher wouldn't be able to sell any copies of the work in the United States 28 years after the initial publication, so most non-US works entered the public domain in the United States either immediately upon publication or 28 years after publication. In 1989, USA signed the Berne Convention, and for that reason, USA was forced to restore copyright to works which were still copyrighted in the source country on 1 January 1996 (see URAA). For some reason, USA decided to give the restored works a full copyright term (95 years from publication), although the Berne Convention doesn't require protecting these works beyond the term in the source country. --Stefan2 (talk) 16:01, 24 October 2013 (UTC)[reply]
